REQUEST FOR PREQUALIFICATION OF CONTRACTORS
Rutherford County Area Habitat for Humanity, Inc. seeks to
prequalify General, Roofing, HVAC, Plumbing, and Electrical
Contractors, from which to solicit bids for our Aging in Place
Program. The funding for this project was provided through a grant
awarded by the Davidson County Chancery Court, Part III from
the SeniorTrust/ElderTrust settlement (Case No. 11-1548-III) and
through a contract administered by the Tennessee Commission on
Aging and Disability.
Scope includes, but is not limited to: accessibility improvements,
mobility modifications, weatherization enhancements and critical
home repairs. Applicable city, state, and federal regulations such as
but not limited to Section 3, Segregated Facility, Section 109, and
E.O. 11246 are required. We are pledged to the letter and spirit of

PUBLIC NOTICE
Rutherford County has applied for Federal Emergency Management Agency (FEMA) Building
Resilience in Communities Grant Program (BRIC) funding through the Tennessee Emergency
Management (TEMA) as a sub-recipient.
Under the National Environmental Policy Act (NEPA), federal actions must be reviewed and evaluated for
feasible alternatives and for social, economic, historic, environmental, legal, and safety considerations.
Under Executive Order (EO) 11988 and EO 11990, FEMA is required to consider alternatives to and to
provide a public notice of any proposed actions in or affecting floodplains or wetlands. EO 12898 also
requires FEMA to provide the opportunity for public participation in the planning process and to consider
potential impacts to minority and low-income populations. This notice may also fulfill requirements
under Section 106 of the National Historic Preservation Act (NHPA).
Funding for the proposed project will be conditional upon compliance with all applicable federal,
tribal, state, and local laws, regulations, floodplain standards, permit requirements and conditions.

Project Title: Engineering Services/Study
Location of Proposed Work: Various roads in the southern part of Rutherford County

Special Flood Hazard Area Zone: This Study is to looks at improvements for service and safety on
three roads in the south portion of Rutherford County. Some of the rights of way lie in the flood
zone AE and AE Floodway (1% annual change flood elevation). Confirmation of the location was
made by reference to the latest Flood Insurance Rate Map, Panel 47149CO0401H dtd 1/5/07. The
proposed study will conform to all applicable and local floodplain regulations. The proposed project
after completion of the study will be for widening/installation of shoulders of roadways, possible
relocation of road for safety, and upgraded ditches/culverts.
Proposed Work and Purpose: Rutherford County proposes to have an engineering study with the
intent of raising the level of service and safety on County roads.
Project Alternatives:
Alternative #1 (no action alternative): Under the No Action Alternative, the road will be inadequate
for projected traffic load in the area.
PUBLIC COMMENTS: Any individual, group, or agency disagreeing with the proposed projects
and is wishing to comment on these projects may submit written comments to the Rutherford

on the aquatic environment.
Pursuant to The Tennessee Water Quality Control Act of 1977, T.C.A. §69-3-108 and Tennessee
Rules, Chapter 0400-40-07, the proposed activity described below has been submitted for approval
under an Aquatic Resource Alteration Permit and Section 401 Water Quality Certification. Section
401 of the Clean Water Act requires that an applicant obtain a water quality certification from
the state when a federal permit is required. This notice is intended to inform interested parties of
this permit application and draft permit and rationale, and to ask for comments and information

PROJECT DESCRIPTION / PURPOSE
The applicant proposes to fill 0.21 acres of a 2.53-acre wetland (wetland-2) for the development
of lots in a multi-phased residential community. The remaining on-site aquatic features will not
be impacted. Compensatory wetland mitigation is proposed with the purchase of 0.42 wetland
mitigation credits from the Tennessee Mitigation Fund, Middle Cumberland River Service Area.
ANTIDEGRADATION
The affected waters have available parameters for habitat. As described in the accompanying permit
rationale, the Department has made a preliminary determination that the proposed activity will result
in greater than de minimis degradation of waters with available parameters. Any appreciable permanent
loss of resource value associated with the propose impact is proposed to be offset by sufficient mitigation
to result in no overall net loss of resource value. Pursuant to Antidegradation Statement, in waters with
available parameters for habitat, an activity that would cause degradation of habitat above the level of
de minimis will only be authorized if applicant has demonstrated to the Department that there are no
practicable alternatives to prevent or lessen degradation associated with the proposed activity and the
degradation is necessary to accommodate important economic or social development in the area and
will not violate the water quality criteria for uses existing in the receiving waters.
FACTORS CONSIDERED
In deciding whether to issue or deny this permit, the Division will consider all comments of record
and the requirements of applicable federal and state laws. The division will consider the nature,
scale and effects of proposed impacts. The Division will consider practicable alternatives to the
alteration, loss of waters or habitat, diminishment in biological diversity, cumulative or secondary
impacts to the water resource, and adverse impacts to unique, high quality, or impaired waters.
In addition, the Division will consider whether more than de minimis degradation is justified by
important social or economic development in the area.
In making this decision, a final determination will be made evaluating appreciable permanent loss
of resource values and proposed compensatory mitigation to ensure the project will not result in
no overall net loss of state water resources values.
HOW TO COMMENT
TDEC is requesting public comment on this proposed permit action. Obtaining a broad range
of facts and opinions on Agency actions is one of the best ways to ensure appropriate decisions.
Persons wishing to comment on the proposal are invited to submit written comments to the
Division. Written comments must be received within thirty days following distribution of the
approved public notice materials (including signage and newspaper ad). Comments will become
part of the record and will be considered in the final decision. The applicant’s name and permit

After the Division makes a final permit determination, a permit appeal may be filed by the applicant
or by any person who participated in the public comment period whose appeal is based on comments

Interested persons may request in writing that the Division hold a public hearing on this application.
The request must be received by the Division within the comment period, indicate the interest of the

When there is sufficient public interest in water quality issues, the Division will hold a public hearing

Rutherford County Government is seeking to apply for the Federal Emergency Management
Agency (FEMA) Building Resilient Infrastructure and Communities Grant Program (BRIC)
funding through the Tennessee Emergency Management (TEMA) as a sub-recipient.
Under the National Environmental Policy Act (NEPA), Federal actions must be reviewed
and evaluated for feasible alternatives and social, economic, historic, environmental, legal,
and safety considerations. Under Executive Order (EO) 11988 and EO 11990, FEMA is required
to consider alternatives to and to provide public notice of any proposed actions in or
affecting floodplains or wetlands. EO 12898 also requires FEMA to provide the opportunity
for public participation in the planning process and to consider potential impacts on minority
and low-income populations. This notice may also fulfill requirements under Section 106
of the National Historic Preservation Act (NHPA).
Funding for the proposed project will be conditional upon compliance with all applicable
federal, tribal, state, and local laws, regulations, floodplain standards, permit requirements,
and conditions.

Special Flood Hazard Area Zone: This project is to construct five (5) multi-purpose Public
Safety Centers.
Rutherford County owns the property where the proposed facilities will site. Two properties
are in flood zones AE Floodway (1% annual chance flood elevation) and X (unshaded). The
remaining three properties are in zone X (unshaded). The confirmation of the property locations
was identified by referencing the latest Flood Insurance Rate Map, Panel 47149C0230J
dated 10/16/2008 and 47149C0305H, 47149C0245H, 47149C0134H, 47149C0381H dated
1/5/2007. The proposed work will conform to all applicable floodplain regulations.
Proposed Work and Purpose: Rutherford County proposes to construct five (5) multi-agency
Public Safety Centers, each containing EMS and Fire quarters, a community safe room,
tornado siren, and office space available for law enforcement. The new multi-purpose facilities
intend to improve county infrastructure and the public safety presence in the fast-growing
rural areas of Rutherford County. The Public Safety building will connect EMS, Fire, and
Law enforcement to the citizens to help provide a safety-oriented community. The dual-purpose
facility could be essential for survival and recovery during and after a large incident for
the citizens in those areas.
Project Alternatives:
Alternative #1 (no action alternative): Under the No Action Alternative, without the Rutherford
County Public Safety Centers, the citizens that live or drive through the proposed site
location areas will not have an available safe shelter to seek during a tornado or high wind
event. Also, the increased presence of first responders in those areas could shorten response
times, increasing the likelihood of protecting citizens, and saving lives.
