Work center leader under fire for violations

Violations ranging from nepotism to misuse of county property are “pervasive” at the Rutherford County Correctional Work Center and must be stopped, County Mayor Ernest Burgess vowed Thursday.

Burgess, who chairs the Work Center Board, told board members appointed Superintendent Alan Miller must be held accountable for the pattern of misconduct the mayor agonized over since April.

“I’m really convinced we don’t have the proper leadership and supervision in place,” Burgess told the board, later saying, “We’re going to have to take affirmative action. We’re at risk.”

Miller asked the board to investigate before rushing into a decision.

“I’m not willing to be the victim of something I believe has been contrived to make me look bad,” Miller said.

Board members decided to adjourn and meet individually with Burgess to learn more details about the violations the mayor didn’t disclose during the meeting. Miller said he wanted his attorney present before he met with board members.

The Work Center, located on South Church Street, houses about 140 minimum security inmates convicted of non-violent and misdemeanor crimes. Miller is the superintendent governed by the board consisting of members Burgess, vice chair Tom Hartley, John Taylor, Grant Kelley and Frances Mosby.

During the meeting, Burgess outlined disciplinary action taken toward employees.

There is some risk of actions happening internally, the mayor said. Those actions must be corrected to ensure proper security.

Since April, Burgess said he’s agonized daily and spent numerous hours about issues at the work center. The actions permeate faster and deeper than he originally believed, adding he held Miller and the board responsible.

“It’s a serious matter,” Burgess said.

While he did not elaborate, Burgess quoted violations of the county’s Employee Handbook and work center’s general operations including:

• Nepotism, including relationships between supervisors and those they supervise, and married couples working in the same department.

• Conflicts of interest.

• Careless use of supplies and equipment.

• Failure to maintain harmony.

• Loitering, lounging and sleeping during work hours.

“These are just a partial list of items deemed for corrective action,” Burgess said.

• Insubordination.

• Excessive use of cell phones.

• Use of immoral language or jokes.

• Failure to follow department rules and regulations.

• Destruction or false entries on records or documents.

• Violations of safety rules.

• Inappropriate use of county cell phones and Internet.

• Inadequate job performance.

• Use of annual leave when attending court on a personal basis.

• Fraternization with inmates.

• Discussion of personnel and work center business with inmates.

• Possession of or being under the influence of illegal drugs or alcohol.

• Unauthorized use of county property.

• Reports of time off under false pretenses.

• Personal use of county equipment.

• Misuse of county property.

• Socialization on duty.

• Misuse of annual leave in court on personal business.

Several employees were identified for violating the principles, employee handbook or general orders, the mayor said.

“It appears to me some of the things I read and enumerated, there is a pattern,” Burgess said, with activities pervasive to the department.

Rutherford County has the right to terminate employees at will, and employees may be terminated immediately without warning for theft, insubordination and falsification of county documents, the mayor said.

“In view of the pervasive sort of action, he has to be held accountable,” Burgess said of Miller. “Mr. Miller’s creditability is severely harmed and damaged that he can’t lead an organization. There’s so much damage, I don’t know if it’s possible.”

Poor judgment has been shown repeatedly, the mayor added.

Miller countered several key employees resigned and accusations started about his behavior, including anonymous letters. He talked to Burgess about replacing people in the key positions but the captain and lieutenant slots remain unfilled.

The superintendent asked the board to investigate, saying some allegations were based on a conspiracy between employees to provide false information.

The board wanted to investigate.

In his almost 12-year tenure, Miller said the work center stayed within budget, refrained from being sued in major lawsuits or in federal court and prevented serious injuries among employees and inmates.

“If you look, we have a pretty good record,” Miller said.

I am very happy to see that the mayor is stepping up to the plate and is doing somthing to stop the corruption in this county. I agree with springs, the Sheriffs office needs some serious overhauling.

When will they leave this guy alone??? I know Mr. Miller. He has done a lot for this city AND county! He was "dumped on" when he worked for the city and now the county is picking right up where they stopped.
I thought Haley had retired? Is he running the county now??? Did I dose off and miss an election???????

What happened to being innocent until proven guilty? This sounds like a personal attack. Does the mayor really have any proof of all of the charges or is he just trying to take the heat off of himself for the bible park caper? Maybe he should check with Ms.stephenson and the relationship she has with a former employee of the workcenter that was asked to resign for material that was found on his computer that was deemed smut. Isn't the HR director the daughter of former Commissioner Faye Elam who still works for the county. What about Mr. Gill and his brother? Isn't he still working at the Central Office? How many husbands and wives work for the Sheriff? Oh, dosen't Commissioner Farley's son work for the Sheriff? What about Shirley Jones? Isn't her husband the director of county codes and please don't let me forget Lisa Nolen and her husband, Mac, who heads solid waste.
Does anybody recall Deputy Kyle Burgess who is the Mayor's son. Think the Mayor really knows what nepotism or conflict of interest really means?

Let's not forget the Community Learning Center (CLC). The private alternative school the County funds. They have three total staff. Principle= Husband, Asst. Prin/Lead Teacher = Wife , and the third teach = no relation.

It's important to handle all County Departments the same. When you start nit picking it begins to look shady.

I have known Mr. Miller professionally for 10+ years and have known him to be an excellent department head for the County.

Alot of innocent hardworking people are being hurt here. The mayor should give good faith warnings and investigate before setting up the county for several wrongful termination lawsuits. What's the mayor doing not discussing all this over time and correcting it before it becomes this level of problem anyway?

I'm a country boy and it easy to confuse me, but if Burgess new about this since April and he had to "angonize" over it for 6 months...why didn't he just tell the other members on his Board. Didn't he say they were as responsible as Miller. Does he not trust them either or did he want to handle it like the Bible Park situation...by himself. Lookout Board Members you may be next to be axed.

Hey Tuddie..Burgess don't care how much of your money he spends and he's got plenty...have you ever check his salary for being on the Board of NHC...look it up, it's on the net.While u r looking check that little company he gets another dump truck full of money from that has it's HQ in the Caymen Islands...hey don't they set those companies up there so THEY DON'T TO PAY TAXES!!!!! Mr.Miller is suppose to be a leader in a work house facility which is a part of our local law enforcement. I am glad someone is holding him accountable for the failure to be a leader.

I THINK MR.MILLER IS A FINE MAN AND ABLE TO HANDLE HIS JOB CORRECTLY IF YOU DO MORE INVESTIGATING THAN YOU ACTUALLY ARE I BELIEVE YOU WOULD FIND OUT THE FACTS BEFORE YOU GO TO POINTING FINGERS AT MR MILLER DONT YOU THINK THE HUMAN RESOURCES AND MAYORS OFFICE NEEDS TO BE INVESTIGATED THEY ARE THE ONES IT SEEMS ARE NOT DOING THERE JOB!!!! All I know is there is a lot of fingers being pointed and the ones pointing probably have no idea what is going on inside the workhouse. For the ones of you who are pointing fingers why don't you start pointing them at yourself? It's not like you have never done anything wrong!!! While you are at it why not add a few things to that list of violations? Where is favoritism and hostile work enviroment? Surely those would be there with a list of "accusations" shown above. I think everyone should leave well enough alone, mind their business, and leave the workhouse employees alone.

Has anybody noticed that no other media has reported on this other than the Post. Wonder why? Is the Post the only news source that is interested; the only one that knew; or the facts of the Mayor's complaint so sketchy that no one else cares?

My opinion is neither personal or professional. It's an opinion just like yours (whatsthis)...You on the otherhand sure are offended by the fact that our mayor has taken the facts he has received and is doing a investigation. Needs to happen more often as far as I am concerned..

Hey, anybody happen to see the news tonight? Looks like the Rutherford County Correctional Center isn't doing everything wrong. Don't know about you but I'm sure Mr. Hopper is happy that Mr. Miller was around.
