SUBSTITUTE TRUSTEE'S NOTICE OF SALE OF REAL ESTATE

 

WHEREAS, by deed of trust dated July 5th, 2007, T Scott Mason, unmarried, conveyed to Caren C. Gabriel, Trustee for ASCEND FEDERAL CREDIT UNION, a certain lot or parcel of land together with the buildings and improvements located thereon, lying and situated in the 12th Civil District of Rutherford County, State of Tennessee, bounded and described as follows:

 

BEING all of Lot No. 39, OAKLEIGH SUBDIVISION,

 

SECTION I”A”, according to plat and survey appearing of record in Plat Book 21, page 49, of the Register’s Office of Rutherford County, Tennessee, to which plat reference is hereby made for more complete details of location and description of said lot.

 

BEING the same property conveyed to T. Scott Mason, by quitclaim deed from Beth A. Mason, dated May 25, 2007, appearing of record in Record Book 749, page 1077, of the  Register’s Office of Rutherford County, Tennessee. See also deed of record in Deed Book 631, page 586, of said Register’s Office.

Said deed of trust above is recorded in Record Book 762, page 1710, Register's Office, Rutherford County, Tennessee, to which reference is made for full particulars; and

 

WHEREAS, Kelly H. Bechard has been appointed Substitute Trustee, according to the provisions of this trust deed, by an Appointment of Substitute Trustee, of record in Record Book 1271, page 3983, Register's Office, Rutherford County, Tennessee, and

 

WHEREAS, T Scott Mason defaulted in payment of the indebtedness under the terms and provisions of said deed of trust and under the note secured thereby.

 

NOW, THEREFORE, by virtue of the power and authority vested in me, I, KELLY H. BECHARD, as Substitute Trustee, will sell at public outcry to the highest and best bidder, for cash, the above described real estate with all improvements thereon, on March 11th, 2014, at 11:00 a.m., at the east door of the Courthouse in Murfreesboro, Rutherford County, Tennessee.  Said property will be sold free from and in bar of the rights and equity of redemption, statutory rights of redemption, homestead, dower and all other rights or exemptions of every kind, such being expressly waived in said deed of trust.  A Successor Trustee's Deed conveying said property without any covenant or warranty expressed or implied, but subject to all unpaid taxes and any liens which take priority as a matter of law, will be made and delivered to the purchaser of said real estate.

 

The right is reserved to adjourn the day of the sale to another day and time-certain, without further publication and in accordance with law, upon announcement of said adjournment on the day and time and place of sale set forth above.

 

Said sale is made subject to all oral announcements made at the sale.
