Smith trial may be continued for DNA test

Trial may be postponed for a man accused of fabricating evidence in his wife’s disappearance and for making four false statements to police officers.

Defendant Glover Palmer Smith, 73, of Village Green Circle was charged in March with using his wife, Marcie’s, SUV to affect the outcome of an investigation into her disappearance. He was also charged with making false statements to Officer Bobby Edwards and Detective Maj. Jim Gage.

Marcie Smith, 69, a diabetic who relies on insulin to live, disappeared in December 2007. Her husband told police she disappeared Dec. 6. Her SUV was found the next day at Wal-Mart on Rutherford Boulevard. She has not been located.

After a court hearing Monday, Smith told a reporter he was waiting for his wife to come home or her remains to be found.

Defense attorney Libbi Snider told Circuit Court Judge Don Ash she might ask the trial to be continued from Oct. 13 to conduct an independent test of DNA taken from the SUV.

Snider said Assistant District Attorney Trevor Lynch verbally gave her the results of DNA found in his wife’s SUV but said he didn’t have the written report yet.

Snider said she believed the defense had the right to seek an independent DNA test, a delay that might continue the trial.

Ash told her to file the motion.

Snider and Lynch discussed sharing of evidence, including telephone records and Marcie Smith’s medical records.

Lynch said he will give Snider cellular telephone records but didn’t have the home telephone records. Also, Lynch said he didn’t have authorization to turn over the medical records. Lynch questioned the relevance of her medical records.

Ash ordered him to turn over the records.

Smith is set for trial Oct. 13 but a murder trial is scheduled first. He remains free on bond.

I'm betting if some skillful interrogater was to sweat this mope, he'd come clean. I empathized with the guy at first, but know it's becoming obvious he knows a lot more than he is willing to give up. If he's lying, he may as well hang a sign around his neck that says "I did it."

So if his DNA is in her car, that means what?

It wouldn't be relevant for his DNA to be in her car, but if somebody else's DNA is found then than opens the door to reasonable doubt.

If the DNA came from a drop of blood especially if it were in the rear part of the vehicle, it would be relevant. They could get a DNA sample from her hairbrush to match it up with. Whatever it is it has the attention of the defense attorney.

Second thought: I am not a DNA expert, but if the driver of the SUV did not wear gloves "they" may be able to get a DNA sample by swabing the shift lever to activate persperation residue. That may be why the defense wants their own expert, to see if the only DNA present was that of the defendent.
