One man accused of having sex with an 11-year-old relative was indicted by the grand jury this week, a Murfreesboro Police detective reported.

Suspect Malcom T. Smith, 19, of Manor Drive was charged with child rape and aggravated sexual battery of the girl, Detective Tommy Roberts reported.

Department of Children’s Services employees notified Roberts about the allegations.
When interviewed at the Child Advocacy Center, the girl reported she spend the night with her father and stepmother.

She accused Smith of penetrating her and fondling her, the detective reported.

Roberts interviewed Smith before presenting the case to grand jurors, who issued the two indictments.

He was booked into Rutherford County Adult Detention Center. He is scheduled to receive a copy of the indictments Oct. 19 in Circuit Court.
