FORECLOSURE SALE NOTICE

WHEREAS, Brenda Webb, by a Deed of Trust, dated September 9, 2005, of record in Record Book 545, Page 2850, Register's Office for Rutherford County, Tennessee, conveyed to Randall Clemons, Trustee, the hereinafter described real property to secure payment of a promissory note as described in said Deed of Trust; and

WHEREAS, Robert Evans Lee having been appointed Substitute Trustee by Wilson Bank & Trust, the owner and holder of said note by an instrument of record in Record Book 895, Page 1187, Register's Office for Rutherford County, Tennessee, with authority to act alone with the powers given the Trustee; and

WHEREAS, default having occurred with respect to the note secured by the Deed of Trust, and the full balance owing having been accelerated; and

Notice is hereby given that on the 19th day of August, 2016, Letters Testamentary in respect of the estate of Merwin L. Frizzell, deceased, who died July 10, 2016, were issued to the undersigned by the Probate Court of Rutherford County, Tennessee. All persons, resident and non-resident, having claims, matured or unmatured against the estate are required to file the same with the Clerk of the above named Court on or before the earlier of the dates prescribed in (1) or (2), otherwise claims will be forever barred:

(1) (A) Four (4) months from the date of the first publication (or posting, as the case may be) of this Notice if the creditor received an actual copy of the Notice to Creditors at least sixty (60) before the date of the date that is four (4) months from the date of the first publication (or posting); or
