Murfreesboro detective indicted for off-duty incident | MPD, James Boske

A Murfreesboro Police detective was indicted Tuesday on charges of reckless endangerment and aggravated assault.

Detective James Boske was indicted after a shooting April 6 at a home on Valencia Drive in Smyrna, Sgt. Bobby Gibson reported.

“Our investigation determined that the resident, James Boske, and a visitor, Mark Garvey, had been involved in a physical altercation within the residence,” Gibson reported. “During the altercation, Boske, a detective with the Murfreesboro Police Department, fired two shots from his personally owned handgun. Both shots were fired within the master bedroom of the residence.”

Boske’s wife Barbara was present during the altercation and neither she, Boske or Garvey, a former detective with the Murfreesboro Police Department, were injured by gunfire.

The incident was investigated by the Smyrna Police Department, the scene was processed, the firearm was secured into Smyrna evidence and all involved persons provided a statement about the incident.

Smyrna Police presented the case to the Rutherford County grand jury Tuesday and grand jurors indicted Boske. He was booked Wednesday into Rutherford County Adult Detention Center.

He is scheduled to receive a copy of the indictments May 19 in Circuit Court.

Murfreesboro Police placed Boske handling administrative but not law enforcement duties during the investigation.

Police spokesman Kyle Evans said Boske is expected to remain on a decommissioned status while awaiting the outcome of the judicial process.

i am actually on his side here. mark it down. he has every right to protect his home, family, and himself. he was indicted SIMPLY because it's simpler to let a jury of his peers find him not guilty. grand jury duty is to not appear soft on crime. where's the NRA??? where is the CONSTITUTION? if it was self defense, this dude needs a good attorney. here's hoping for the best for you Mr. Boske.

Keptman- You're right! Law officers have the same right as you or I to protect their home and family. Since officers are trained to hit what they shoot at and since there were no injuries, I think he was just trying to get Garvey to leave his house, rather than hurt him. If this is the case I hope the MPD will treat him like any other citizen defending their home. Why ruin a man's career and life for doing what we all would do if pushed to it?

You all are right in that L. E. Officers have the right to protect their homes, as do every other citizen. Keep in mind that there are details that have not been released, as there is in all criminal investigations, to the public. There is more to this story than meets the eye or the press for that matter.
