RESOLUTION NO 12-R-25 INITIAL RESOLUTION AUTHORIZING THE INCURRENCE OF INDEBTEDNESS AND THE BORROWING OF FUNDS BY THE CITY OF MURFREESBORO, TENNESSEE, IN THE AMOUNT OF NOT TO EXCEED TEN MILLION DOLLARS ($10,000,000), BY OBTAINING A LOAN FROM A PUBLIC BUILDING AUTHORITY PURSUANT TO A LOAN AGREEMENT TO PROVIDE FUNDING FOR CERTAIN PUBLIC WORKS PROJECTS, AND TO FUND THE INCIDENTAL AND NECESSARY EXPENSES RELATED THERETO. WHEREAS, it is necessary and in the public interest of the City of Murfreesboro, Tennessee (the "Municipality"), to borrow funds and incur indebtedness (the "Indebtedness"), through the execution with The Public Building Authority of the City of Clarksville, Tennessee (the "Authority"), of one or more loan agreements (collectively, the "Loan Agreement"), for the purpose of financing certain public works projects, as hereinafter more fully described. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MURFREESBORO, TENNESSEE, AS FOLLOWS: SECTION 1. For the purpose of financing all or a portion of the costs of certain public works projects, consisting of the acquisition of equipment and vehicles for police, fire, solid waste, transportation, and other departments, including but not limited to, fire trucks and rescue vehicles, new collection vehicles for the solid waste department, the acquisition of communication and technology improvements, including but not limited to software, and radio communications equipment for the police department, the acquisition of all other property real and personal appurtenant thereto and connected with such work, and to pay all legal, fiscal, administrative, and engineering costs incident thereto (collectively, the "Project"), and to pay all costs incident to incurring the Indebtedness, the Municipality is hereby authorized to incur the Indebtedness, in the amount of not to exceed Ten Million Dollars ($10,000,000), for the financing of the Project. The rate or rates of interest payable pursuant to the provisions of a Loan Agreement shall be shall be a variable rate which rate shall not exceed the maximum rate of interest permitted under the laws of the State of Tennessee. SECTION 2. The indebtedness evidenced by the Loan Agreement shall be payable from any and all funds of the Municipality legally available therefore , including, but not necessarily limited to, ad valorem taxes to be levied for such purpose on all taxable property within the corporate limits of the Municipality, without limitation as to time, rate, and amount and, for the punctual payment of said principal of, premium, if any, and interest on such bonds, the full faith and credit of the Municipality will be irrevocably pledged. SECTION 3. The Loan Agreement shall be executed pursuant to the provisions of Title 9, Chapter 21, Tennessee Code Annotated, as amended (the "Act"), and Title 12, Chapter 10, Tennessee Code Annotated, as amended. SECTION 4. After the adoption of this Resolution, the City Recorder is directed to cause this Resolution, with the notice prescribed by the Act, to be published in full once in a newspaper published and having general circulation in the Municipality. NOTICE: Invitation to Bid (ITB) Sealed proposals will be received by the City of Murfreesboro for a Nine (9) 23-Passenger Medium-Duty Low Floor Transit Buses at the City of Murfreesboro, Office of the City Manager, located on the first floor of City Hall, Post Office Box 1139, 111 West Vine Street, Murfreesboro, Tennessee 37133-1139, any time prior to the hour of 3:00 P.M. CST Thursday, November 1, 2012. Any proposal received thereafter will be considered unresponsive. The Medium-Duty Low Floor Transit Buses will be partially funded by the Federal Transit Administration. Proposals must follow the Format and Instructions available from the City of Murfreesboro at http://www.murfreesborotn.gov/default.aspx?ekmenu=100&id=7802. Licenses may be renewed in person at the Building & Codes Dept. in City Hall, 111 W. Vine St., 8:00 AM – 3:30 PM. You may also renew by mail, sending required forms and payment to Building & Codes Dept., P. O. Box 1139, Murfreesboro, TN 37133-1139. Electrical licenses renewed October 1 thru 31 will be subject to a $50.00 late fee; November 1 thru 30 a $100.00 late fee.
