DOCUMENT 00030 ADVERTISEMENT FOR BIDS Notice is hereby given that the City of Murfreesboro, Tennessee, will accept separate Sealed Bids for the construction of the Murfreesboro City Hall Energy Efficiency Retrofits located in downtown Murfreesboro, Tennessee. Sealed Bids will be received at the Building and Code Director’s Office, 111 West Vine Street, Murfreesboro, Tennessee 37130-3573, until 2:00 p.m. local time, January 12, 2011, and then at said time publicly opened and the bids read aloud in Administrative Conference Room. Bids received after the above time and date will be rejected and returned to Bidder unopened. All bids must be in accordance with the Contract Documents prepared and issued by Griggs & Maloney, Inc. located at Suite 205, 745 South Church Street, P.O. Box 2968, Murfreesboro, Tennessee, 37133 and Entech Engineering Inc., located at Suite 140, 5301 Virginia Way, Brentwood, Tennessee 37027. The following is a general description of the Project: The City of Murfreesboro, Tennessee acquired an Energy Efficiency and Conservation Block Grant (EECBG) to retrofit the existing Murfreesboro City Hall building. The goal of the EECBG project is to increase energy efficiency, reduce greenhouse gas emissions and electricity use, and increase occupant comfort. Work includes demolition, removal, and upgrade of existing equipment including but not limited to lighting fixtures, variable air volume boxes, dampers, and air cooled chiller. In addition, lighting controls, an energy management system, power monitoring devices, and outside air units will be installed. A mandatory pre-Bid conference will be held at 2:00 PM local time on December 16, 2010 at the Murfreesboro City Hall, located at 111 West Vine Street, Murfreesboro, Tennessee 37130-3573. Representatives of the OWNER and ENGINEER will be present to discuss the project. General Contractors are required to attend the conference. Failure of any General Contractor to attend the pre-bid conference will automatically disqualify their bid, which will be returned unopened at the bid opening. ENGINEER will transmit to all prospective Bidders of record such Addenda as ENGINEER considers necessary in response to questions arising at the conference. Oral statements may not be relied upon and will not be binding or legally effective. The construction time is 250 calendar days. A “Bid Bond” or other approved bid security in the amount of 5 percent of the bid amount must accompany the submitted bid. The successful Bidder will be required to furnish a Performance Bond and a Payment Bond, each for 100 percent of the contract amount as security for the faithful performance of the work and the payment of all bills and obligations arising from the performance of the work. All alternates requested on the bid form will be considered in the award of the Contract. All bidders must be licensed contractors as required by the Contractors Licensing Act of 1976 (TCA Title 62, Chapter 6). No bid will be opened unless the sealed envelope containing the bid provides the following information: the Contractor's license number, the date of the license's expiration, that part of his classification applying to the bid, and other information required by law or contained in the Instruction For Bidders. No faxed bids will be accepted. All bids must be in a sealed envelope marked CITY HALL ENERGY EFFICIENCY RETROFITS. The Contractor and all Subcontractors and Manufacturers will be required to represent and warrant to and for the benefit of the Purchaser and the Department of Energy that (a) the Contractor and all Subcontractors and Manufacturers have reviewed and understand the Buy American Requirements, (b) all of the iron, steel, and manufactured goods used in the project will be and/or have been produced in the United States in a manner that complies with the Buy American Requirements, unless a waiver of the requirements is approved, and (c) the Contractor and all Subcontractors and Manufacturers will be required to provide any further verified information, certification or assurance of compliance with this paragraph, or information necessary to support a waiver of the Buy American Requirement, as may be requested by the Purchaser, the Department of Energy or other vested entity. AMERICAN RECOVERY AND REINVESTMENT ACT (ARRA) REQUIREMENTS This project is being funded by the American Recovery and Reinvestment Act (ARRA) of 2009. The grant recipient and all Contractors, subcontractors, manufacturers, and vendors must be in compliance with all applicable ARRA-mandated Davis-Bacon and Buy American requirements. DISADVANTAGED BUSINESS ENTERPRISES (DBE) REQUIREMENTS Any contract or contracts awarded by the Owner through this invitation for bids will be funded by a Energy Efficiency and Conservation Block Grant from the Department of Energy. Federal funds will be involved in this project and, as a result, Bidders must comply with the Disadvantaged Business Enterprises (DBE) requirements including contacting a minimum of 10 qualified Disadvantaged Business Enterprises (DBE) potential sub-contractors, professional service providers, vendors, and/or suppliers by certified mail to solicit bids. The apparent successful Bidder must submit to the Owner copies of the certified letters and return receipts prior to contract award. Neither the Department of Energy nor any of its departments, agencies, or employees is or will be a party to this Invitation for Bids or any resulting contract(s) awarded by the Owner.
