Notice is hereby given that on the 2 day of October 2012, Letters Testamentary, in respect of the estate of Gayle Kinnard Ross, deceased, who died September 10, 2012, were issued to the undersigned by the Probate Court of Rutherford County, Tennessee. All persons, resident and non-resident, having claims, matured or unmatured against the estate are required to file the same with the Clerk of the above named Court on or before the earlier of the dates prescribed in (1) or (2), otherwise claims will be forever barred:

NOTICE TO CONSULTANT ENGINEERS & PLANNERS
REGARDING A REQUEST FOR LETTERS OF INTEREST FROM TDOT PRE-QUALIFIED FIRMS
Transit Center Preliminary Design & Environmental Study
October 14, 2012
The City of Murfreesboro seeks to retain the services of consulting firm(s) to provide professional design and planning services to conduct preliminary engineering and environmental analysis for the new City of Murfreesboro transit center.
The project entails formulation of a master plan and preliminary design to the extent necessary to prepare an environmental study in a format and manner that will facilitate environmental review and clearance by the Federal Transit Administration for a new transit facility to accommodate typical transit operations and house transit management staff and employees, provide passenger waiting areas, passenger loading and unloading area, employee and visitor parking, provide bus storage and other support amenities consistent with a full service public transit facility. The selected consultant will be responsible for development of the master plan, preliminary design and formulation of complete environmental documents.
TDOT pre-qualified firms may request consideration by submitting a Letter of Interest to Mr. Rob Lyons, City Manager, 111 West Vine Street, Murfreesboro, TN 37130.  All letters of interest must be received by the City on or before 3:00 p.m. local time Wednesday October 24, 2012.  The letter of interest shall indicate the scope of services to be completed by any sub-consultants.
Engineering firms and other sub-consultants (greater than $100,000 contributed services) must be TDOT pre-qualified with an unlimited status or have a completed pre-qualification form with original signature filed with TDOT by the deadline for the Letters of Interest.
TDOT pre-qualification procedures, example letter of interest, list of pre-qualified forms, current “Standard Procurement Policy for Engineering and Technical Services” and additional information can be found at the internet address:  www.TDOT.state.tn.us/consultantinfo.htm.  
The City will evaluate the current pre-qualification statements on file for those submitting letters of interest and choose several firms who would make viable candidates from which to invite proposals and/or presentations.  Factors that will be considered in evaluation of proposals are:
a. Past experience in the required disciplines with City and other clients.
b. Qualification and availability of staff.
c. Demonstrated ability to meet schedules without compromising sound engineering practice.
d. Evaluations on prior City projects, if available.
e. Demonstrated ability to successfully complete a project of similar size and scope.
f. Amount of work under contract with City.
g. Whether the consultant can perform the work efficiently without compromising sound engineering practice.
h. Other factors considered relevant by the evaluation committee.
Method of payment for the Contract will be cost plus net fee for the design services.

LEGAL NOTICE OF PUBLIC MEETING
The Board of Zoning Appeals will consider the following item under “Old Business.”
Application Z-12-052 by Mr. Mike Chaudhary, is requesting a 200-foot variance from Section 21(B)(4) of the City of Murfreesboro Zoning Ordinance, which states that the sale or distribution of gasoline, diesel, and other fuels for motor vehicles will be permitted in the Commercial Fringe (CF) zoning district only when developments for such are setback a minimum of 200 feet from any property zoned in the RS or RD classifications.  The request is pertaining to property located at the southwest corner of New Salem Highway and Saint Andrews Drive.   All interested parties are
invited to attend; however, there will not be a public hearing with regard to this matter.  A public hearing was held regarding the above item at the September 26, 2012 regular meeting of the Board of Zoning Appeals, at which time the Board voted to defer action.

LEGAL NOTICE OF PUBLIC HEARINGS
Application S-12-050 by Mr. Michael Rubino of GPD Group, for Thornton’s, Inc., is requesting a variance from Section 25¼-24 (A)(22) of the City of Murfreesboro Sign Ordinance which prohibits a sign placed in or over a public utility or drainage easement on property located at 2908 Medical Center Parkway. All interested parties are invited to attend.
Application S-12-055 by Mr. Bobby Kirby for IPM, is requesting a variance from Section 25¼-24 (A)(22) of the City of Murfreesboro Sign Ordinance which prohibits a sign placed in or over a public utility or drainage easement on property located at 2018 Medical Center Parkway.  All interested parties are invited to attend.
Application Z-12-056 by Mr. Gary Wisniewski for Stratford Hall, LLC, is requesting a variance from Section 34, Article V(A)(5) of the City of Murfreesboro Zoning Ordinance, which states that, in all floodprone areas, all electrical, heating, ventilation, plumbing, air conditioning equipment, and other service facilities shall be designed and/or located so as to prevent water from entering or accumulating within the components during conditions of flooding.  The request is pertaining to property located at 1320 Charleston Boulevard.   All interested parties are invited to attend.
Application Z-12-057 by Mr. Richie Bolin for Middle Tennessee Christian School, is requesting a 10-foot variance from the minimum required 30-foot front building setback for accessory structures, as stated in Chart 2 (Minimum Lot Requirements, Minimum Yard Requirements, and Land Use Intensity Ratios) of the City of Murfreesboro Zoning Ordinance, for property located in a Medical District Commercial (CM) zone at 280 East MTCS Road.  The applicant is also requesting a variance from Section 25(E)(5) of the Zoning Ordinance which states that in all
commercial and industrial districts, accessory structures and uses shall comply with the same front setback as is required for the principal structure.  All interested parties are invited to attend.   
Application Z-12-058 by Mr. Mike Jones, for the North Boulevard Church of Christ Men’s Ministry, is requesting a special use permit in order to operate a
temporary outdoor vending establishment (Christmas tree sales) in a Commercial Highway (CH) zone for property located at 1266 Northwest Broad Street.  All interested parties are invited to attend.
Application Z-12-059 by Mr. Dan Onkst, for Boy Scout Troop 197 of Fellowship United Methodist Church, is requesting a special use permit in order to operate a temporary outdoor vending establishment (Christmas tree sales) at an institutional group assembly use (a church) in a Residential Single-Family (RS-15) zone for property located at 2511 New Salem Highway.  All interested parties are invited to attend.

CITY OF MURFREESBORO
APPLICATION FOR EXEMPTION OF WEEDS AND GRASS ORDINANCE
LEGAL NOTICE OF PENDING EXEMPTION
Applicant Three Oaks Development Company, LLC is requesting an exemption from the weeds and grass ordinance on the property located along the north side of North Tennessee Boulevard, just south of Mosaic Trail and Terragreen Court, Tax Map 81 Parcel 1.00, as provided in City Code Section 14-53.  It is requested that the property return to a natural state or as a wilderness area.
The neighboring landowners within 250 feet of this property have 30 calendar days to object in writing to the Building and Codes Department, P.O. Box 1139, Murfreesboro, TN 37133-1139.  If the City receives no objection, the exemption will be granted.  If the City receives any objection, the Board of Zoning Appeals will hold a public hearing at its next regularly scheduled meeting.
