SUBSTITUTE TRUSTEE’S NOTICE OF FORECLOSURE SALE DEFAULT having occurred in the performing terms of a promissory note described and secured by a Deed of Trust executed on November 15, 2005, of record in Record Book 565, Page 2631, Register’s Office for Rutherford County, Tennessee, by Ricky L. Blaylock and wife, Ruby J. Blaylock, conveying the property therein described to Kevin T. Clayton, Trustee, to secure said indebtedness therein described to Vanderbilt Mortgage and Finance, Inc. Vanderbilt Mortgage and Finance, Inc. executed an Appointment of Substitute Trustee, naming R.N. “BO” TAYLOR as Substitute Trustee, which is of record in Record Book 1123, Page 2463, Register’s Office for Rutherford County, Tennessee. And DEFAULT having been made in the promising terms of said Deed of Trust, which contains the power to sell upon default, the owner and holder, in accordance with the terms of said Deed of Trust, hereby declares the entire debt due and payable and demands that the said R.N. “BO” TAYLOR, Substitute Trustee, sell the property in accordance with said Deed of Trust. E, 182.69 feet to a steel pin in the W line of the Hide-A-Way Mobile Home Park (Plat Book 9, Page 25); thence S 0 deg. 05 min. 51 sec. E. 340.98 feet to a steel pin (found); thence S 89 deg. 43 min. 20 sec. E. 61.62 feet to a steel pin, thence leaving said mobile home park boundary S 3 deg. 42 min. 58 sec W. 654.43 feet to a steel pin by a fence corner post: thence N 66 deg. 17 min. 02 sec W. 396.20 feet to a steel pin (found) at the SE corner of the Joseph Johnson at ux and Obie Lee Shipp property; Thence N 7 deg. 30 min. 32 sec E. 480.07 feet to a steel pin (found); thence N 7 deg. 30 min. 00 sec. E. 480.00 feet to the point of beginning, more or less. This conveyance is subject to an easement for the use and maintenance of waterlines of record in Deed Book 297, Page 349, of said Register's Office; to an easement to the Consolidated Utility District of Record in Deed Book 362, Page 409, of said Register’s Office; to a general easement to Middle Tennessee Electric Membership Corporation of record in Deed Book 308, Page 742, of said Register's Office; to a 25' right of way easement of record in Deed Book 466, page 369, of said Register's Office; and to all other restrictions, easements, conditions and reservations of record; and to the zoning regulations of tho appropriate governmental body. There is included in this conveyance a 2000 Lifestyle Mobile Home, V1N#DSL2AL3283BA which is located on the within described property and made part of. This being the same property conveyed to Ricky L. Blaylock and wife, Ruby J. Blaylock by Special Warranty Deed from Vanderbilt Mortgage and Finance, Inc. of record in Record Book 565, Page 2629, Register's Office Rutherford for County, Tennessee. The property address is believed to be 418 Jakes Lane, Murfreesboro, Tennessee 37130. In the event of any discrepancy between this street address and the legal description of the property, the legal description shall control. This property includes a 2000 Lifestyle Mobile Home, V1N#DSL2AL3283BA which was purchased under an installment contract-security agreement which evidences the deed of trust and which will stay with the land. The sale of this property is in compliance with Section 9-604 of the Uniform Commercial Code and Tennessee Code Annotated 47-9-604. The sale of the above-described property shall be subject to all matters shown on any recorded plan; any unpaid taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; and any matter that an accurate survey of the premises might disclose. Said sale will be in bar of the right and equity of redemption, homestead and dower, but subject to all tax and prior liens of record in the Register's Office for Rutherford County, Tennessee, which are applicable to this property and unpaid real estate taxes, if any. All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. WHEREAS, default having occurred in the performance of the terms, conditions and covenants under that certain deed of trust (the "Deed of Trust") dated April 28, 2009, executed by Terrell D. Hughes, Jr. and wife, Cathy D. Hughes to Hugh M. Queener, Trustee, the Deed of Trust being of record in Record Book 914, Page 3315, Register's Office for Rutherford County, Tennessee, and Larry D. Craig having been appointed Substitute Trustee by instrument of record in Record Book 1093, Page 2605, said Register's Office; NOW, THEREFORE, I, Larry D.
