CITY OF MURFREESBORO BOARD OF ZONING APPEALS

Regular Meeting, March 27, 2013, at 1:00 P.M. City Hall, 111 West Vine Street, Council Chambers

 

LEGAL NOTICE OF PUBLIC HEARINGS

 

Application S-13-008 by Mr. Charles Stofel of Columbia Neon Co., Inc., for Mr. Eric Moser and Mr. John Harney, is requesting a variance from Section 25¼-24 (A)(22) of the City of Murfreesboro Sign Ordinance which prohibits a sign placed in or over a public utility or drainage

easement on property located at 1806 Memorial Boulevard.  All interested parties are invited to

attend.

 

Application Z-13-009 by Mr. Kevin Guenther of Huddleston-Steele Engineering, Inc., for Providence Christian Academy, is making the following requests for property located at 410

Dejarnette Lane in a Residential Single-Family (RS-15) zone:

• A special use permit in order to expand an existing institutional group assembly use (a private school).  The applicant is seeking approval to construct building additions totaling 42,500 square-feet, as well as other site improvements.  The applicant is also seeking approval for the placement of a total of six (6) portable classroom buildings on the property for use during construction.;and   

• A variance from Section 9(D)(2)(zz)[1] of the Murfreesboro Zoning Ordinance, which states that parking areas for institutional group assembly uses shall not be permitted in the required front yard.

Application Z-13-010 by Mr. R. Lyle Lynch of Johnson & Bailey Architects P.C., for Murfreesboro City Schools, is making the following requests for property located east of

Veterans Parkway and south of Franklin Road in a Residential Single-Family (RS-15) zone:

• A special use permit in order to construct an institutional group assembly use (a public school).; and 

• A 5-foot variance from the maximum permitted 35-foot building height, as stated in Chart 2

(Minimum Lot Requirements, Minimum Yard Requirements, and Land Use Intensity Ratios) of the City of Murfreesboro Zoning Ordinance.

Application Z-13-011 by Ms. Chrissy Clevenger, is requesting a special use permit in order to operate a temporary outdoor vending establishment (food sales) in a Commercial Highway (CH) zone for property located at 1911-2047 Old Fort Parkway.  All interested parties are invited to attend.

 

Application Z-13-012 by Mr. Alton Sims, is requesting a special use permit in order to operate a temporary outdoor vending establishment (retail sales) in a Commercial Highway (CH) zone for property located at 2510 South Church Street.  All interested parties are invited to attend.

 

Application Z-13-013 by Mr. Aaron Blankenship, for Ole South Patriotic, Inc., is

requesting a special use permit in order to operate a temporary outdoor vending establishment

(seasonal fireworks retailer) in a Commercial Highway (CH) zone for property located at the

northeast corner of South Rutherford Boulevard and John Bragg Highway.  All interested parties are invited to attend.

 

Application Z-13-014 by Mr. Jake Loyd, for Mid America Distributors, Inc., is requesting a special use permit in order to operate a temporary outdoor vending establishment (seasonal fireworks retailer) in a Commercial Local (CL) zone for property located at the southeast corner of South Rutherford Boulevard and East Main Street.  All interested parties are invited to attend.

 

Application Z-13-015 by Mr. Jake Loyd, for Mid America Distributors, Inc., is requesting a special use permit in order to operate a temporary outdoor vending establishment (seasonal fireworks retailer) in a Commercial Highway (CH) zone for property located at the southeast corner of

Southeast Broad Street and Kensington Square Court.  All interested parties are invited to attend.

 

Application Z-13-016 by Mr. Jake Loyd, for Mid America Distributors, Inc., is requesting a special use permit in order to operate a temporary outdoor vending establishment (seasonal fireworks retailer) in a Commercial Highway (CH) zone for property located at the northeast corner of

Memorial Boulevard and Airport Road.  All interested parties are invited to attend.

 

Application Z-13-017 by Mr. Marty Thurber, for TNT Fireworks, is requesting a special use permit in order to operate a temporary outdoor vending establishment (seasonal fireworks retailer) in a Commercial Highway (CH) zone for property located at 125 John R Rice Boulevard.  All

interested parties are invited to attend.

 

Application Z-13-018 by Mr. Marty Thurber, for TNT Fireworks, is requesting a special use permit in order to operate a temporary outdoor vending establishment (seasonal fireworks retailer) in a Commercial Highway (CH) zone for property located at 2000 Old Fort Parkway.  All interested parties are invited to attend.

 

The Board of Zoning Appeals will conduct a public meeting during which all interested parties will have an opportunity to ask questions, express opposition, or express support regarding any of the listed applications.  For further information, please contact the Planning Department at (615)-893-6441.

LEGAL NOTICE OF PUBLIC HEARING

 

The Rutherford County Board of Commissioners will hold a Public Hearing on April 11, 2013 at 6:30 p.m. at the Rutherford County Courthouse, Public Square in Murfreesboro, TN, to obtain public comment on the following items:

 

1. Mr. John L. Batey has submitted a rezoning request (13A-003) for property referenced by Tax Map 71, Parcel 30.00 and is located at 5104 Baker Road to be rezoned from Residential Medium-Density (RM) to Agricultural Residential (AR).

2. Mr. Brandon Whitt has submitted a rezoning request (13A-004) for property referenced by Tax Map 79, Parcels 51.00 and 62.00 and is located at 3108 Medical Center Parkway to be rezoned from Residential Medium-Density (RM) to Agricultural Residential (AR).

The purpose of this meeting is to discuss stormwater utilities, stormwater projects, and stormwater funds.

Notice is hereby given that a Public Hearing before the City Council of the City of Murfreesboro, Tennessee, will be held in the Council Chambers of the City Hall, 111 West Vine Street, in said City on Thursday, April 4, 2013, beginning at 7:00

o'clock p.m. for the purpose of considering Ordinance 13-OA-03 to determine whether the territory indicated on the map below, which adjoins the present corporate boundaries, should be annexed and incorporated within the corporate limits of the said City and to consider a proposed Plan of Services for the area.  The area under consideration is the designated area in the map below.  Three (3) copies of the proposed Plan of Services are on file with the Planning Director of the City of Murfreesboro in the City Hall, 111 West Vine Street, Murfreesboro, Tennessee.

beginning at 7:00 o’clock P.M. for the purpose of considering a proposed amendatory Ordinance 13-OZ-04 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, constituting a part of said Zoning Ordinance, at which time and place all interested persons may appear and be heard with respect to said Ordinance.  The proposed amendatory Ordinance, if and when effective, will amend said Zoning Ordinance to zone the territory indicated on the attached map as Highway Commercial (CH) District, simultaneous with annexation.

beginning at 7:00 o’clock P.M. for the purpose of considering a proposed amendatory Ordinance 13-OZ-05 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, constituting a part of said Zoning Ordinance, at which time and place all interested persons may appear and be heard with respect to said Ordinance.  The proposed amendatory Ordinance, if and when effective, will amend said Zoning Ordinance so as to modify the conditions of the Planned Unit Development (PUD) District for the

purpose of increasing the number of residential units in the 18 acre section from 288 units to 312 units, an increase of 24 units.
