REQUEST FOR BIDS
The Rutherford County Highway Commission will accept bids on Monday, August 4, 2014 at 7:00 A.M. at the office of Road Superintendent, 1510 Rutledge Way, Murfreesboro, TN. for the following items:
Painted Pavement Marking Lines
Crushed Stone
The bid will be for a period of one-year beginning: 08-04-14 to 07-31-15
Specifications can be picked up at the Road Superintendent’s office any working day (Mon.- Thurs. 6:30AM to 5:00PM) prior to bid opening date.
The Highway Commission reserves the right to accept any bid in their opinion to be the best, or to reject any or all bids.

LEGAL NOTICE OF PUBLIC HEARING

The Rutherford County Board of Commissioners will hold a Public Hearing on August 14, 2014 at 6:30 p.m. at the Rutherford County Courthouse, Public Square in Murfreesboro, TN, to obtain public comment on the following items:
1. W.R. Thompson has submitted a rezoning request (14-A008) for property referenced by Tax Map 36, Parcels 25.08 and 47.04 and is located along West Jefferson Pike, to be rezoned from Residential Medium-Density (RM) to Commercial Services (CS).
2. Frank Bauer has submitted a rezoning request (14-A009) for property referenced by Tax Map 46, Parcels 34.00 and 34.19 and is located at 611 East Jefferson Pike, to be rezoned from Residential Medium-Density (RM) to Light Industrial (LI).
3. Various Zoning Ordinance amendments (14-5002) regarding Outdoor Entertainment and Amusement uses, Planning Staff applicant.

PUBLIC NOTICE

TO WHOM IT MAY CONCERN: The application described below has been submitted for an Aquatic Resource Alteration Permit under The Tennessee Water Quality Control Act of 1977, T.C.A. §69-3-108. In addition, federal permits may be required from the U.S. Army Corps of Engineers and the Tennessee Valley Authority under §404 of the Clean Water Act and §26a of the Tennessee Valley Authority Act, respectively. Section 401 of the Clean Water Act requires that an applicant obtain a water quality certification from the state when a federal permit is required. This notice may cover applications subject to §401.
No decision has been made whether to issue or deny this permit. The purpose of this notice is to inform interested parties of this permit application and to ask for comments and information necessary to determine possible impacts to water quality. Persons wishing to comment on the proposal are invited to submit written comments to the department.  Written comments must be received within thirty days of the date that this notice is posted.  Comments will become part of the record and will be considered in the final decision. The applicant's name and permit number should be referenced.
The permit application, supporting documentation including detailed plans and maps, and related comments are available for review and/or copying at the department's natural resources section.
Interested persons may also request in writing that the department hold a public hearing on this application. The request must be filed within the comment period, indicate the interest of the person requesting it, the reasons that the hearing is warranted, and the water quality issues being raised. When there is sufficient  public interest in water quality issues, the department shall hold a public hearing in accordance with Rule 0400-40-07-.04(4)(f).
In deciding whether to issue or deny a permit, the department will consider all comments of record and the requirements of applicable federal and state laws. In making this decision, a determination will be made regarding the lost value of the resource compared to the value of any proposed mitigation. The department shall consider practicable alternatives to the alteration. The department shall also consider loss of waters or habitat, diminishment in biological diversity, cumulative or secondary impacts to the water resource, and adverse impact to unique, high quality, or impaired waters.

Impact 1: Latitude: 35.824875     Longitude:  -86.422051
WATERSHED / WATERBODY DESCRIPTION: This project is in the Stones River watershed (HUC 5130203) and will affect the left descending bank of the West Fork Stones River. The West Fork Stones River at this location is characterized by limestone bedrock with small amounts of cobble and transient littoral gravel bars. The current land use is primarily urban residential and the riparian vegetation consists of local saplings and trees dominated by box elder, sycamore, black willow and silver maple. An urban greenway trail runs parallel to this segment of the left descending bank at this location.
West Fork Stones River was assessed in 2009. It is fully supportive of its designated uses and is therefore available for additional impacts to habit.
PROJECT DESCRIPTION: The applicant proposes to stabilize approximately 675 linear feet of the left descending bank of the West Stones River adjacent to the
Highway 99 Bridge and Cason Trail, Rutherford County TN.  The proposed project will utilize riprap on the toe of the bank, planted gabion baskets where feasible and rock jetty deflectors at selected locations. The proposed activities will not require
mitigation.

In accordance with the Tennessee Antidegradation Statement (Rule 0400-40-03-.06), the division has determined that the proposed activity will not result in degradation to water quality.

Application Z-14-044 by Mr. Clyde Rountree of Huddleston-Steele Engineering, Inc., for Providence Christian Academy, is requesting to amend a special use permit originally approved on March 27, 2013 for property located at 410 Dejarnette Lane.  The original special use permit pertains to the expansion of an existing institutional group assembly use (a private school) in a Residential Single-Family (RS-15) zone.  The applicant seeks to amend the special use permit in order to make provisions for a playground on the subject property.  All interested parties are invited to attend.
