Legal Notice of Public Hearing

Notice is hereby given that a Public Hearing before the City Council of the City of Murfreesboro, Tennessee, will be held in the Council Chambers of the Murfreesboro City Hall, 111 West Vine Street, in said City on Thursday, June 26, 2014, beginning at 7:00 o’clock P.M. for the purpose of considering a proposed amendatory Ordinance 14-OZ-28 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, constituting a part of said Zoning Ordinance, at which time and place all interested persons may appear and be heard with respect to said Ordinance. The proposed amendatory Ordinance, if and when effective, will amend said Zoning Ordinance so as to remove a section from the Stratford Hall Planned Residential Development (PRD) District located along Old Lascassas Highway and rezone the section as a separate Center Point Townhomes Planned Residential Development (PRD) District, as indicated on the attached map.

On 23 June, 2014 at 10:00 am, Rutherford County Tennessee will accept sealed bids for the sale of real property referenced below that was bought in by Rutherford County at various delinquent tax sales.
Parcel # 187 00415 ($6835.05)
Additional information on the property will be kept on file in the Rutherford County Mayor’s Office, Suite 101, Historic Rutherford County Courthouse.
Any person interested in bidding on the property listed must appear in person at 10:00 am in Suite 101, Rutherford County Historical Courthouse with their sealed bid and present the same to the Mayor of Rutherford County. The sealed bids will be received until 10:10 am on 23 June, 2014 and then no further sealed bids will be accepted. The Mayor shall then open the sealed bids for the property.
The highest bidder will be the successful bidder, provided however, said bid is subject to an increase bid as stated and set forth in T.C.A. 67-5-2507. Reference is specifically made to the Tennessee Code Provision as concerns this sale of property by Rutherford County. The terms of the sale shall be cash, or certified funds on a bank that is located in Rutherford County, Tennessee. At the time the purchase price is collected, pursuant to T.C.A. 67-5-2507, it will also include a sufficient amount to record the deed. The deed will be without any warranties of any sort.
For the parcel listed there is a dollar figure noted beside the same which includes taxes, penalty, cost and interest. No bid shall be for less than the amount stated for each particular piece of property.
As noted in the Tennessee Code provision referenced above, the deed shall not be executed at the time the sealed bids are opened and a successful bidder identified. Rather, Rutherford County shall make publication in a newspaper indicating the proposed sale, the name of the purchaser and terms, conditions and price of sale. Increases to the bid made by the proposed purchaser must be in an amount of ten percent (10%) or more of the bid already made by the proposed purchaser. At that time, the proposed purchaser who was the successful bidder shall be notified and a date will be fixed when the successful bidder and the person making the highest raised bid shall appear and make offers to determine who shall be the final successful bidder to whom a deed will be issued.

It appearing to the Court that personal service of process is being knowingly evaded by the Defendants; it is hereby ordered that the Plaintiff be permitted to utilize service of process by publication.

It is further ordered that this Notice shall be published in The Murfreesboro Post, a weekly newspaper of general circulation, once weekly for four (4) consecutive weeks beginning on June 2, 2014.
