If, after a child has been adjudged to be a child in need of care, the Court finds a parent or parents to be unfit, the Court may make an order permanently terminating the parent’s or parents’ parental rights.

Each parent or other legal custodian of the child has the right to appear and be heard personally either with or without an attorney. ADVERTISEMENT FOR BIDS

Sealed Bids for the construction of the Department of Public Works 2014 Re-Roof will be received by City of Murfreesboro, Tennessee at the office of the City Administration, 1st Floor, Murfreesboro City Hall, 111 West Vine Street, Murfreesboro, Tennessee 37130-3573, until 10:00 A.M. local time on June 5, 2014, at which time the Bids received will be publicly opened, read aloud, and the apparent successful Bidder identified subject to further bid evaluation. Bids received after the above time and date will be rejected.
The following is a general description of the Project:
Re-roof of the existing approximately 17,000 square feet facility divided into 3 roof areas. Complete tear-off of existing built up roof membranes with unknown insulation on a metal deck on all roof areas. Replace one existing roof with a new TPO membrane roof. Install new truss system and standing seam metal roof over approximately of the front office area and shop area. Remove and replace existing fascia and soffit. Remove and replace gutters and downspouts.   Pressure wash clean the shop area to accept new paint by others. Tuck point brick mortar joints. Remove and replace two rooftop HVAC units and clean existing HVAC ducts. Additive Alternates to the Base Bid include: Removal and replacement of building lettering; window and door store front systems in the existing office portion; new exterior lighting at building front and new interior lighting within the shop bay. Deduct alternates include installation of TPO or EPDM roofing as a substitute for the standing seam metal roof and truss system.
Bids will be received for a single prime Contract. Bids shall be on a lump sum basis, with unit price bid items within as indicated in the Bid Form. All bids must be in accordance with the Bidding Documents prepared and issued by the Issuing Office.

Printed copies of the Bidding Documents may be obtained from the Issuing Office, after 10:00 A.M. local time on May 20, 2014, upon payment of a non-refundable deposit of $200 for each complete set of drawings and specifications. Checks for Bidding Documents shall be payable to “Griggs and Maloney, Inc”. Upon request and receipt of the document deposit indicated above plus a non-refundable shipping charge, the Issuing Office will transmit the Bidding Documents via delivery service. The shipping charge amount will depend on the shipping method selected by the prospective Bidder. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the Bidder’s date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office. No electronic media design document copies will be issued or allowed to be issued for this project without the express written permission of the Engineer. All Bidders must be registered plan holders with the Engineer.
A pre-bid conference will be held at the Public Works Building at 1:30 P.M. local time on May 27, 2014. The address for the Public Works Building is 630 West Main Street, Murfreesboro, Tennessee 37130. The meeting will begin at the Front Office. Attendance at the pre-bid conference is highly encouraged but is not mandatory.
A “Bid Bond” or other bond security in the amount of 5 percent of the bid amount must accompany the submitted bid.
The successful Bidder will be required to furnish a “Performance Bond” and a “Payment Bond”, each for 100 percent of the contract amount, as security for the faithful performance of the work and the payment of all bills and obligations arising from the performance of the work.
All bids, which shall include the costs for payment and performance bonds when required, shall remain binding on the Contractor for a period of 60 days after the bid date and time and the Owner reserves the right to accept any bid or bid alternate, to reject any or all bids, or to waive any informalities in bids received where such acceptance, rejections, or waiver is considered to be in the best interest of the Owner. All alternates requested on the bid form will be considered in the award of the Contract.
All bidders must be licensed contractors as required by the Contractors Licensing Act of 1976 (TCA Title 62, Chapter 6). No bid will be opened unless the sealed envelope containing the bid provides the following information: the name, license number, expiration date thereof, and license classification of the contractors applying to bid for the prime contract and for the masonry over $100,000, electrical, plumbing, heating, ventilation, and air conditioning contracts, and for each vertical closed loop geothermal heating and cooling project, the company name, Tennessee Department of Environment and Conservation license number, classification (G, L, or GL), and the expiration date, appear on the outside of the envelope containing the bid except when the bid is in an amount less than twenty-five thousand dollars ($25,000) [masonry over $100,000]. When the bid is less than twenty-five thousand dollars ($25,000), the name of the contractor only may appear on the outside of the envelope containing the bid, and upon opening the envelope, if such bid is in excess of twenty-five thousand dollars ($25,000), the same shall automatically be disqualified. Only one (1) contractor in each classification may be listed. Prime contractor bidders who are to perform the electrical, plumbing, heating, ventilation, and air conditioning or the geothermal heating and cooling must be so designated upon the outside of the envelope. Failure of any bidder to comply therewith shall void such bid and the envelope containing such bid shall not be opened or considered. The failure of any bidder to comply with all of the provisions hereof shall automatically disqualify such bid.
No faxed bids will be accepted. All bids must be in a sealed envelope marked “Department of Public Works 2014 Re-Roof.”

After the meeting was duly called to order, the following resolution was introduced by G. Coates, seconded by P. Lamb and after due deliberation, was adopted by the following vote:

INITIAL RESOLUTION AUTHORIZING THE   SMYRNA/RUTHERFORD COUNTY AIRPORT AUHORITY TO INCUR INDEBTEDNESS IN AN AGGREGATE PRINCIPAL AMOUNT OF NOT TO EXCEED $200,000 THROUGH THE ISSUANCE OF ITS REVENUE BONDS
WHEREAS, the Board of Commissioners of the Smyrna/Rutherford County Airport Authority (the "Authority") has determined that it is necessary and advisable to incur indebtedness for certain public improvements as more fully set forth herein; and
WHEREAS, pursuant to Sections 42-3-111 and 9-21-301 et seq., Tennessee Code Annotated, as amended, prior to issuing bonds for said purposes, it is necessary to adopt an initial resolution authorizing said bonds.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioner of the Smyrna/Rutherford County Airport Authority, as follows:
1. For the purpose of providing a portion of the funds for the: (i) construction and equipping of airport buildings and facilities (the "Projects") of the Authority, (ii) payment of legal, fiscal, administrative, architectural and engineering costs incident to the Projects, (iii) payment of capitalized interest during construction of the Projects and for up to six months thereafter, and (iv) payment of costs of issuance and sale of the revenue bonds, the Authority is hereby authorized to issue revenue bonds in an aggregate principal amount of not to exceed $200,000. The bonds shall bear interest at a rate or rates not to exceed the maximum rate permitted by law and shall be payable solely from the revenues derived from the operation of the airport owned and operated by the Authority.
2. The Chairman or Vice-Chairman, or either of them, is hereby directed and instructed to cause the foregoing initial resolution to be published in full in a newspaper having a general circulation in Rutherford County, Tennessee and in the Town of Smyrna, Tennessee, for one issue of said paper.
This Resolution shall be in immediate effect from and after its adoption, the public welfare requiring it.

(This variance pertains to the proposed Sonic restaurant lot, which is to be subdivided off of the master parcel.); and
  • A 7’ variance from Section 24, Article III (E)(4)(b)[3] of the City of Murfreesboro Zoning Ordinance, which requires a minimum of 7’ between buildings and parking and/or access drives on lots of less than 1.5 acres.

Application Z-14-033 by Mr. Rick Cantrell of PSMT, for Mr. John Zhang, is making the following requests for property located in the Residential Multi-Family (RM-16) zone at 903 and 907 Southeast Broad Street (also identified as Tax Map 102E, Group C, Parcels 04700 and 04600):

  • A 3’ variance from Section 27(J) of the City of Murfreesboro Zoning Ordinance which requires a minimum 8’-wide front planting yard where the site is between one (1) and two (2) acres.;
  • A variance from Section 26(C)(1)(b)(2) of the City of Murfreesboro Zoning Ordinance, which states that parking spaces or access aisles for parking spaces of multi-family dwellings located in the RM-16 district shall not be located within a required front yard.; and
  • A variance from Section 27(L)(1)(b) and Table 1 of the City of Murfreesboro Zoning Ordinance, which state that a Type C buffer zone is required to be planted when property in a Residential Multi-Family (RM-16) zone abuts property in a Residential Duplex (RD) zone.

Application Z-14-036 by Mr. Clyde Rountree of Huddleston-Steele Engineering, Inc., for Mr. John Westlund of the Presbyterian Student Fellowship, is requesting a special use permit in order to expand an existing student center in a Residential Multi-Family (RM-16) zone for property located at 2529 Middle Tennessee Boulevard and 618 Crestland Avenue.
