Probation for two years was granted to a man who entered pleas Tuesday to unlawful photography and criminal impersonation.

David Simmons, 57, of 3032 Cimarron Trail was charged in May with eight counts of felony unlawful photography of his girlfriend, criminal impersonation and felony vandalism.

As part of his plea, Simmons was sentenced to six months, suspended, for the criminal impersonation charge. He was sentenced to two 11-month and 29-day jail terms, suspended, for two counts of unlawful photography.

Sheriff’s Detective Ralph Mayercik said at the time Simmons and the woman engaged in a sexual act and Simmons allegedly took her photograph during the act without her knowledge.

“She dumped him” later, the detective said. “He didn’t take that well and decided he was going to get even.”

Simmons allegedly printed the photographs and send the pictures in Christmas cards to her family. Some family members opened the card while she was able to intercept other cards.

Rather than go through a trial, Simmons entered the pleas in Circuit Court.

He will be supervised by Providence probation for the next two years since the six-month sentence will be run at the same time as the 11-month and 29-day sentence.

They should have put him in slammer where he could really "focus" on trying to protect his own behind....
