Three 17-year-old Riverdale High School students accused of severely beating a newspaper carrier last week on Big Eagle Trail were released Tuesday on strict house arrest.
Victim Mark Henry suffered “severe” injuries in the beating, Murfreesboro Police Officer Ricky Haley said in a detention hearing last week.
Henry, who had a black eye, said he couldn’t stand up very well and asked if he could sit when he addressed Juvenile Court Judge Donna Scott Davenport with his concerns.
Since the assault, Henry said several cars have been coming by his home and he asked how to handle that.
Davenport told the boys their friends didn’t help their case by taking matters into their own hands. She imposed a “gag order” on the victim, the boys and their families to not discuss the case with anyone, saying the case would not be tried on the streets or in the media but in her courtroom.
The judge explained to Henry and the parents that under state law, the purpose of Juvenile Court was not to punish children but to treat and rehabilitate them for delinquent behavior.
“My job is to stop that behavior now,” Davenport said.
Assistant District Attorney Leslie Collum said she explained to Henry the boys could be released. If adults, they could have already made bond.
Henry said he could accept strict house arrest.
Under house arrest, Davenport ordered the boys:
• Leave their house only with their parents or to go to school.
“If the parents don’t supervise them, they will be in contempt and locked up,” Davenport said.
• Refrain from contacting the victim or his family or each other.
School Resource Officers will notify Davenport if they see the boys communicating with each other, the judge said.
“I’m like the great Oz,” Davenport said. “I’m going to know it.”
• Abide by school and household rules.
• Drive only to and from school with no side trips.
• Refrain from drinking alcohol.
The house arrest will be in force until their October trial.

This whole thing reeks of adult picking on a child. I'd doubt these kids get a fair chance right now, with the judge on some power trip it seems.

The Judge gives the boys a pat on the hand while the adult suffers for all his injuies he sustained by these kids. Where's the justice?

looks like to me these boys need to take responsiblity for their own actions. they are seventeen and know the difference between right and wrong. they need a good taken out behind the barn beating. i know that is what i would get if i had done anything like this. it comes down to the golden rule. do unto others as you would have them do unto you. thats the problem with the world today. practice this rule and you might learn something

I'm sorry, but these boys are 17 years old. The word "child" should not even be thrown into the mix. But since they are technically juveniles, I can understand why Judge Davenport did what she did.
I have a question. At what point is it determined that juveniles can be tried as adults? Could that still happen in this case?

It's not the judge's choice whether they are tried as adults; that particular pleasure belongs to the district attorney, who then must file the motion for transfer to adult court and successfully win it in trial. The judge just doesn't get to "declare" that they are adults.

attagirl, you obviously work for the juvenile court system or have some extensive knowledge of the system and processes. I've read other posts you've made on other cases. Thank you for keeping others informed of the juvenile laws and legalities.

Why not keep them in juvenile detention until school starts?? That way they would be off the streets. The parents would be able to work and keep their jobs without the stress of what these boys are doing while they are at work trying to make a living. Sitting at home on house arrest makes for a lot of free time and boredom. Who said the carrier incited the whole mess? And no one but those involved know how the teen got injured. How about just let the court figure it out.

House Arrest? You've got to be kidding! What an absolute crock. 17 Year olds who can beat a kid silly are capable of being tried as adults - and for those who would gasp in liberal do-gooder horror at that idea, get a grip on reality, it is common practice to try "children" of this age as adults.

missymom, the purpose of juvenile detention is not to babysit kids that the parents obviously aren't watching. There are plenty of people who should be "off the streets," but out law doesn't allow us to just lock them up for that reason alone. Even an adult who committed this crime would be granted bond.
The boys claim that the driver pulled into their yard and pulled a knife on them. One of them supposedly has quite a few stitches. Their friends were on this forum a few nights ago defending themselves, but all the posts got deleted.

The teens friends should have refrained from public defense participation. Especially on public forum.
I am sure that that the acting legal representation defending these guys would have disapproved of this also.
Anyone who is knowledgable of the legal system know what their friends were posting could hinder the case.
