DUI of the Week: Open container violation

A Murfreesboro man is facing multiple charges after an open liquor bottle was found in his car when Officer Klint Hill stopped him for a noise violation Oct. 14 at 810 N.W. Broad Street.

Anand R. Kapadia, 22, was arrested on suspicion of driving under the influence for the second time. He since has been charged with a DUI 2nd offense, driving on a revoked license, violation of the implied consent law, and violation of the open container law, according to the arrest report.

“Upon exiting the vehicle, he was unsteady on his feet,” Hill reported. “I then asked (him) to submit to field sobriety tests, and he refused to comply. At that point, I placed him under arrest.”

During the stop, an open bottle of vodka was found behind the passenger seat of the vehicle, according to the arrest report.

Kapadia was convicted July 8, 2010, of a DUI 1st offense in Rutherford County.

If convicted of a DUI 2nd offense, he could face a fine of up to $3,500, and 11 months and 29 days in jail, in addition to other penalties.

He is scheduled to appear Nov. 9 in General Sessions Court.
