DUI of the Week: Man tries to use cigarettes as ID

A Rockvale man whose license is suspended is facing multiple charges after attempting to use cigarettes as his identification when police reportedly caught him sleeping Friday in his car on Fortress Boulevard.

Jackey Mooney, 26, has been charged with driving under the influence, driving on a suspended license, violation of the implied consent law, violation of the open container law, and possession of a Schedule VI substance, according to a Murfreesboro Police Department arrest report.

“Mooney was passed out behind the wheel of his Nissan Altima with the engine running,” the arrest report said. “I asked (him) for his driver’s license registration and proof of insurance. Mooney provided a case of cigarettes and stated that it was his identification. … In plain view, in the center console, Mooney possessed an open bottle of alcohol.”

After Mooney failed to complete field sobriety tests, he admitted to consuming six alcoholic beverages shortly before driving, at which point he was placed under arrest, Ferrell reported. During a routine search, police also found a small bag of marijuana in Mooney’s “front, left jean pocket” when he was being taken into custody.

Mooney was then transported to the Rutherford County Adult Detention Center, where he was charged accordingly, and held on a $4,000 bond. He is scheduled to appear March 22 in General Sessions Court.
