A sealed indictment charged a suspected drinking Bedford County man with killing a Murfreesboro driver in a crash in January, court documents stated.

Defendant Steven Davis, 28, of Unionville was indicted on charges of two counts of aggravated vehicular homicide of Thomas Morris Jr., 46, of Spring Leaf Court. Davis was also indicted on charges of DUI (third offense) and possession of a Schedule III drug.

Davis’ blood alcohol level measured .20 or more when tested after the crash, the indictment stated. A blood-alcohol level of .08 is considered driving under the influence of alcohol in Tennessee. Also, Davis had a criminal history of two other DUIs in February 2001 and February 2005.

Tennessee Highway Patrol Trooper Michael Marvin, who investigated the crash, reported at the time Morris was driving Jan. 4 on Versailles Road near Rockvale when Davis crossed the centerline in his speeding Ford F-150 truck and struck him head-on.

Both men were trapped in the wreckage.

“Alcohol was involved,” Marvin said.

Davis was booked into Rutherford County Adult Detention Center and released on $50,000 bond. His plea is set Aug. 19 in General Sessions Court.

"Defendant Steven Davis, 28, of Unionville was indicted on charges of two counts of aggravated vehicular homicide of passenger Thomas Morris Jr., 44, of Silver Leaf Drive. Davis was also indicted on charges of DUI (third offense) and possession of a Schedule III drug."

Ok. I'm confused. Did more than one person die in the wreck or did Davis kill Morris TWICE?

No, just once. . . . . but that should be more than enough for a conviction.

Just hope Judge Clayton does not get this case. Mr. Davis may only get a slap on the wrist if that happens! A very similar case occurred a number of years ago on Memorial Highway - a man over twice the legal limit traveling at a high speed crossed the center line and killed a husband and father of 2 children and was only given 18 months! Judge Clayton stated that society would not benefit by giving the defendant a longer sentence!

Clayton retired.

I feel that a person with this many DUI's should not even be allowed to post bail..he may get drunk again and drive once more, perhpas bringing heartache to yet another family....

It's just terrible that crimes like these still occur. We hear over and over and over again that drinking and driving don't mix, but everyone seems to think he or she is invincible.

Can someone explain the TWO counts of aggravated vehicular homicide?...

Very poorly worded article. I can't believe the writer gets paid for this low quality work. That being said, I would like to know what this moron got for sentencing on his first 2 dui's. He should get life for this one.

Who was the second victim in this incident. Given two counts of aggravated vehicular homicide, there should be two victims, or am I missing something?

Perhaps Lisa meant two charges, one of aggravated vehicular homicide and one of DUI?

Three strikes for this guy and he finally killed somebody. One would think after DUI number two he should have been deprived of his driving privileges for at least 5 years.

It would be interesting to see the official numbers on the recidivism rate among DUI offenders. I remember seeing/reading or hearing somewhere (and I can't recall where) that 70% do not repeat the offense. That leaves 30% who are likely hard core alcoholics and shouldn't be driving in any event. A five tear suspension with proof of sobreity during that period would be appropriate for two time offenders. Three times and you should be riding your bicycle for life.

You can get a DUI on a bicycle to.

SocEtTuem, I looked up recidivism rates and found a very interesting study done by the American Health Institute comparing DUI recidivism between whites and hispanics. Here's the resuls:

Rates of recidivism were significantly lower for Mexican Americans (5%) compared to whites (11%) who were arrested for DUI but not convicted, but higher for those convicted (12% vs. 5%).

While conviction status of the identifying DUI offense was not predictive of recidivism among Mexican Americans, a DUI conviction in the preceding year was significantly predictive.

Among white arrestees, receiving a conviction was significantly, and negatively, predictive of recidivism, but among those who were convicted, a previous DUI conviction in the last year was predictive of recidivism.

Referral to a DUI treatment program was not a significant predictor of recidivism among those convicted in either ethnic group.

Conclusions: The data suggest that conviction for a DUI may not play the same role in the likelihood of subsequent DUI convictions for Mexican Americans as for whites, and this difference may need to be considered in DUI treatment programs. Additional research on ethnic differences in DUI offenses and recidivism over longer periods of follow-up is needed to determine ethnic-specific intervention and prevention strategies for DUI.
