County settles lawsuit in 11-year-old girl's death

Survivors of an 11-year-old girl killed when struck by a sheriff’s cruiser July 17, 2008 received a $220,000 settlement from Rutherford County.

Pedestrian Lakeisha White of Hopkinsville, Ky., died from injuries suffered in the crash on Bradyville Pike with former sheriff’s Sgt. Ron Killings.

Killings faces trial Feb. 8 on reckless homicide charges.

Lakeisha’s mother, Montessa Gomez, filed a civil lawsuit three weeks after her daughter’s death seeking $7.5 million for the wrongful death and loss of her daughter, the lawsuit stated. Her six minor siblings Montavious White, George Gomez, La Mon Thornton, Ebonie Gomez, Courtney Gomez and Brooklyn Thornton sought $250,000 apiece.

Her grandmother Brenda Carneal and her cousins, Rayneshia Coleman, Terry Coleman and Moniaveshia Collier, all asked for $250,000 apiece for suffering from observing the crash or being within the “zone of danger,” the lawsuit stated.

Under a settlement approved by Chancellor Robert Corlew,

• Mother Gomez received $170,500.

• Carneal received $11,157.58.

• Cousins Kim Coleman received $9,560.26. while her three minor children received $19,282.16.

• Lakeisha’s five brothers and sisters received $100 each. Another brother received $9,000.

After the settlement, Corlew dismissed the lawsuit.

I assume they'll be using their "winnings" to pay for counseling to help ease their "suffering"...?

I imagine their "suffering" was eased the minute they found a lawyer to take their case. Wonder how much of this settlement he got?

It is actually well-settled law in Tennessee (and most other states) that witnesses to accidents are entitled to recover if they are in the "zone of danger" (words of the court, not the plaintiffs) and suffer emotional harm.

I would say that it is not unreasonable that people who witnessed a child get hit by a car were well within the zone of danger and most certainly suffered some sort of emotional distress.

This is a joke, how many cases like this one have you ever heard of that the civil case has been settled before the criminal trial, no doubt the office Bart Durham was afraid they would get nothing. Weak case no doubt. This only shows how weak over all the criminal case will be.

i suppose that the middle of the street was the zone of danger since his vehicle never left the roadway?

The siblings only get $100 each while extended family gets anywhere from $9,560.26 to $170,500?!? Makes no sense at all...especially since one brother got $9000 while the rest of them only got $100.
