A 47-year-old man whose license is revoked was arrested on suspicion of driving under the influence Friday evening after being stopped for a broken light on South Church Street in Murfreesboro.
Kerry C. Smotherman, of Christiana, has been charged with a DUI third offense, violation of the implied consent law, and a ninth offense of driving on a revoked license.
Due to the latter charge, he has also been charged as a habitual offender, according to a Murfreesboro Police Department arrest report filed by Officer Blake Troutman.
“I was on patrol when I observed a vehicle with a passenger side brake light out,” Troutman reported. “I conducted a traffic stop for the light law violation and made contact with the driver.”
Troutman reported Smotherman appeared to be intoxicated, noting he had slurred speech and bloodshot eyes.
When he failed to perform field sobriety tests as demonstrated, Smotherman “advised he had consumed alcohol,” Troutman reported.
“A driver’s license check revealed a revoked status with eight prior convictions,” he reported. “Smotherman also had two prior DUI convictions and is a habitual offender.”
Smotherman was taken into custody and transported to the Rutherford County Adult Detention Center. During booking, he refused to consent to a blood test, prompting the second charge to be filed against him.
He has since been released on an $8,000 bond.
A preliminary hearing in the case is scheduled for Thursday, Nov. 15, in Rutherford County General Sessions Court.
