A former Murfreesboro employee filed a discrimination lawsuit in federal court earlier this week, alleging he was fired “because he is Hispanic,” the suit said.
Former Fleet Services Manager Juan Orozco asked for a jury trial when he filed suit against then city of Murfreesboro for his 2008 termination. Orozco is seeking monetary damages, in the form of lost wages and punitive damages, along with attorney’s fees.
“As a matter of policy, the city does not comment on current or pending litigation,” Murfreebsoro spokesman Chris Shofner said when asked for a comment on the lawsuit.
In the lawsuit, Orozco alleges he was fired after two of his employees became involved in an affair.
The affair came to light when one of parties involved told Orozco she was being harassed by the other party. Orozco then reported the affair to the city’s personnel department.
The harassment allegation led to then City Manager Roger Haley investigating the Fleet Services Department.
The investigation “ultimately led to the filing of 15 charges of violation of various city policies by (Orozco) and Mr. Haley’s recommendation that (Orozco’s) employment be terminated,” the suit said.
Orozco then requested a disciplinary hearing that resulted in an additional 12 violations of city policies being filed against him.
“Despite the proof presented at (Orozco’s) disciplinary hearing rebutting the charges against (him), Mr. Haley made the decision to terminate (his) employment,” the suit said.
The suit also claims Haley said city vehicles were in “the best shape that he has ever seen” under Orozco’s direction of the department.
Orozco also alleges the city filled his job with a white male before the disciplinary hearing was even held, that other department heads often violate the same policies he was accused of violating and that the two employees who were engaged in the affair received a 30-day suspension and transfer respectively.
In the end, Orozco is alleging the city “intentionally discriminated against him and accorded him disparate treatment because he is Hispanic,” the lawsuit said.

Hispanics should get no special privilages. They were not forced to come here; they migrated just like the rest of us. You don't here about Italians starting discrimination lawsuits....If you don't like it here, just leave. It's a real simple fix.

There are people born and bred here that get everything from food stamps to free medical care. The very same people are able to get up, go to work and do not. One reason that may be is because they are not forced to get up and get a job.

I wish him much luck, I truly do. I wouldn't want to be in his shoes, but he might have even been trying to do the city a favor by preventing a harassment suit from being filed by the woman, who in turn could have named the city as party for not protecting her from harassment.
This is sad.

I believe this city is very crooked-i.e. look around at how many cops are using steroids. And by the way when was the last time anyone in this town was busted for steroids? So, why wouldn't I believe that this man was a victim of some sort of crooked power struggle? Maybe he should have filed it under some other form of illegal firing such as...crooked city clause? And one more question I have is if someone can get arrested for being under the influence of alcohol or cocaine or marijuana then why in the heck isn't a person who exhibits signs of aggression and hostility in public arrested just like a person on any other legal or illegal drug named above is? Everyone in this city has seen the large proliferation of huge-muscled thugs coming and going from many public establishments such as a certain gym and many restaurants and bars (alcohol consumption turns their violence up even more)! Wake up Murfreesboroans-steroids can hurt you even if you're not the one using them-i.e. look at the poor victim attacked in the Kroger's parking lot by the steroid-abusing Mr. Garrett!!!

plainugly, What does steroids have anything to do with this story? I think if you are going to hurl insults and accuations around, you should man up and give us some proof other than a few guys are in good shape.

Plain, no doubt steroid use is a problem and many users will deny it has anything to do with their anger issues.
Of course you're going to see huge-muscled men (and maybe even some well-defined women) coming from gyms and in public places like restaurants and bars. They share common interests. And how do you explain the even larger proliferation of the average built general public coming from bars and restaurants? Are they all just intoxicated, happy and silly drunks?
I believe I know what certain gym you're referring to. I was a member. I have to say, none of them have ever been more than polite, considerate, and professional. None of them ever exhibited even a holier than thou attitude with me.
It doesn't mean they are all on steroids or hostile. Some of them may be vain, but that's expected. You're stereotyping them as thugs.
There's quite a broad line between identifying and arresting substance abusers and arresting someone who "exhibits signs" of aggression and hostility. Unless a person actually harasses or physically attacks another person in public, there's nothing to arrest them for.
abide - if the man's legality in the US was the problem, he wouldn't have a lawsuit. That would be the first thing the department could terminate him for.
It's wrong for people to assume someone is Hispanic, therefore must be illegal. You, Admiral, and Deeg are all stereotyping.

Bella- There is an hispanic family on the street behind me. They are wonderful, hard working people who never bother anyone, their children are well cared for, and they get up and go to work every day. They speak or wave as they pass my house each morning, and I am proud to have them for neighbors. I was born in the deep south and wear the name "redneck" proudly. Please don't judge us all by a few.

Ahhh Boo, Bella wasn't judging you all. "Bella" is a common "Italian" expression and affectionate nickname. She noticed Deeg stereotype "Italians."
She made her counterpoint. I had an interesting conversation recently with a really nice southern-born man online who was bothered by the lack of hair on his head, and complained it was unfair for "Italians to have all this hair on their back and toes," and why couldn't he have just some of it on his head.
I did laugh at the way he expressed, but aslo informed him I am an American-born Italian ;)~~.

Next question, does anyone know why Mr.Orozco is pursuing the suit?

Mtsufan1978, my accusation of many cops in Rutherford County being on steroids is not imaginary, it is what I have heard by the health care professionals who drug test them. The way I remember it is that the tester said if the cops were tested for steroids over HALF would lose their jobs and that he sees them when they come in for a pre-hire drug test and then boom six months or so later they come in and suddenly they are huge! That it's obvious to him that it's from steroid use. The federal DEA investigation into steroid sales that lead to charges being filed on I believe at least one Nashville cop ought to have opened up the public's eyes. These cops carry weapons and that coupled with Roid Rage can be a very dangerous scenario. Just as with the long delayed realization that a huge amount of pro baseball players have been using and selling steroids it seems that people like you like to live in the dark. Wake up! There is a huge percentage of cops using steroids and very few arrests for these illegal drugs in our county and people are getting hurt by steroid induced violence. The innocent victim that got his skull crushed at the Krogers near the college with one punch from the steroid using bondsman Garrett is the best example!

Convince your health care professional friend who tests them, to witness and produce the evidence and take it to the DEA.
No one is denying there's evidence that steroid use is devastating to both the user's physical and mental health status, or that it can endanger themselves and others. No one is denying it is illegal. IMO it's plain stupid for anyone to use it.
However, to exaggerate a "huge percentage of cops" as users? Early 2008, a metro Nashville police spokesperson stated they requested the cooperation of the DEA in weeding out users; the investigation extended into Murfreesboro even, resulting in a new officer being fired.
I'll leave it up to you to explain why the DEA didn't also expose the "huge percentage" in our county, you intend to expose.

Plain, just a suggestion but you would do your friend a favor by having him look into HIPPA and Privacy laws. Just a thought since he obviously brings his work home to share with his friends.
